Former IGP and Defence Secy, convicted and sentenced to death over Easter massacre
They have previously compensated victims
Former IGP Pujith Jayasundara and former Defence Secretary Hemasiri Fernando were sentenced to death by the Colombo Permanent High Court Trial-at-Bar on Friday after being found guilty of failing to prevent the 2019 Easter Sunday terrorist attacks despite receiving prior intelligence warnings.
The verdicts were delivered following separate trials against the two former senior security officials, who were indicted by the Attorney General on charges including criminal negligence, dereliction of duty and aiding and abetting deaths arising from their alleged failure to act on advance intelligence of an imminent terrorist attack.
The judgments were delivered by a three-member Trial-at-Bar comprising Justices Priyantha Liyanage, Thilakarathna Bandara and Viraj Weerasuriya.
In Jayasundara’s case, Justices Liyanage and Bandara found the former Police Chief guilty of aiding and abetting deaths through criminal negligence and dereliction of duty, while Justice Weerasuriya dissented, holding that the prosecution had failed to establish the charges beyond reasonable doubt.
Jayasundara was consequently convicted on 854 of the 855 charges filed against him and sentenced to death.
Fernando was also convicted by a majority decision of the same bench after Justices Liyanage and Bandara found him guilty of the charges. Justice Weerasuriya again dissented, ruling that the prosecution had failed to prove the allegations beyond reasonable doubt.
The former Defence Secretary was likewise found guilty on 854 of the 855 charges contained in the indictment and sentenced to death.
The prosecution alleged that both accused had failed to take timely preventive measures despite receiving intelligence reports warning of impending terrorist attacks, resulting in the coordinated suicide bombings carried out on Easter Sunday, April 21, 2019.
Jayasundara served as Sri Lanka’s 34th Inspector General of Police from April 2016 until he was sent on compulsory leave following the attacks. Fernando was serving as Defence Secretary at the time.
In a separate fundamental rights case, the Supreme Court in January 2023 held both officials personally liable for violating the fundamental rights of the victims through their failure to prevent the attacks. Jayasundara was ordered to pay Rs. 75 million in compensation, while Fernando was directed to pay Rs. 50 million. Both have since paid the amounts ordered by the Court.
The two former officials were initially acquitted by a previous Colombo Permanent High Court Trial-at-Bar on February 18, 2022, without being called upon to present their defence. The Attorney General appealed the acquittals, and the Supreme Court subsequently ruled that the decision was contrary to law, setting aside the acquittals and directing that the trials proceed.
The retrials were thereafter conducted before the present Trial-at-Bar, with proceedings in Jayasundara’s case concluding on June 12 and Fernando’s on June 13 before the judgements were delivered on Friday.

Ranawaka accuses govt. of using JVP cadres and police to suppress political opponents
… reminds AKD led over 560 protests during Yahapalanaya
Former Yahapalana Minister and United Republican Front (URF) leader Patali Champika Ranawaka yesterday (19) alleged that the JVP, which carried out over 560 protests during the 2015-2019 period, was now bent on preventing the Opposition from exercising its democratic right to protest.
Recalling the declaration made by the JVP at the height of the violent protest campaign in July 2022 that it would set the Parliament ablaze, the former parliamentarian lashed out at the JVP-led administration for using the police excessively to curb political opposition. Ranawaka said this while addressing the media at the former President Ranil Wickremesinghe’s Flower Road Office .
Commenting on the protest campaign launched by the Maha Sangha, demanding presidential pardon for General Secretary of the Bodu Bala Sena (BBS) Ven. Galagotaatte Gnanasara, the ex-Colombo District lawmaker alleged that President Anura Kumara Dissanayake used a combination of police, investigative units and JVP cadres to break up the monks’ protest. The government went to the extent of compelling the JVP/NPP-run Colombo Municipal Council (CMC) to deprive the peaceful protesters of basic toilet facilities, he alleged.
The government’s actions proved that only those with prior approval from JVP Pelawatte headquarters could launch protests in Colombo, its suburbs or in the provinces. The police have become a political tool in the hands of the JVP, the ex-Minister said. (SF)
