Accused indicted over heroin trafficking undergoes heart surgery, seeks bail

The Court of Appeal has issued notice on the Attorney General, returnable on August 26, in respect of an application for the revision of the order of the High Court of Chilaw, refusing bail to an accused who had been in remand for over six years.
The accused appellant in the Court of Appeal is Nelson Thamel indicted over heroin trafficking.
The accused has undergone by-pass surgery, while in remand prison, where he could not get the medically recommended diet and the exercise.
Bail was refused twice on June 19, 2020 and December 23, 2020.
The High Court refused bail, stating that there was no risk of the accused getting Covid-19, while in prison. But he had contracted Covid-19 in January 2021, President’s Counsel Rienzie Arsecularatne who appeared for the accused appellant stated.
President’s Counsel Arsecularatne appeared with Chamindri Arsecularatne, Udara Muhandiramge and Thilina Punchihewa.
The Court of Appeal bench comprised Justice Menaka Wijesundera and Justice Neil Iddawela.
