SC upholds prison sentence of ex-DIG Hector Dharmasiri

The Supreme Court has upheld the High Court’s decision dismissing the appeal filed by former Deputy Inspector General (DIG) Hector Dharmasiri against the three-year prison sentence imposed on him by the Colombo Chief Magistrate’s Court, Commission to Investigate Allegations of Bribery and Corruption (CIABOC) stated.

In 2007, while serving as the Superintendent of Police in charge of the Matale division, the convict deployed Civil Security Officers, under his supervision, to construct his private residence in Minuwangoda.

Following an investigation, the CIABOC instituted legal proceedings against him in the Colombo Chief Magistrate’s Court on 15 charges. The Colombo Chief Magistrate’s Court convicted him of six charges and sentenced him to six years’ imprisonment, to be completed within three years. In addition, by the judgment delivered on 02 July, 2019, the Magistrate imposed a fine of Rs. 300,000. Hector Dharmasiri appealed to the High Court against the decision of the Magistrate’s Court, but the High Court dismissed it.

Accordingly, he filed this petition in the Supreme Court through his Attorneys-at-Law. The said decision of the Supreme Court was pronounced accordingly. Mrs. Anusha Sammandapperuma, Assistant Director (Legal), who appeared on behalf of the Commission to Investigate Allegations of Bribery or Corruption, submitted facts at the hearing of the petition. Mr. Asitha Anthony, Deputy Director General, conducted the prosecution in the Magistrate’s Court.
