May 09 mayhem: BASL accuses police of indiscriminate arrests, demands AG’s intervention

Published

The Bar Association of Sri Lanka (BASL) has called for the intervention of Attorney General Sanjay Rajaratnam, PC, to prevent what it calls indiscriminate arrests.This follows incidents of physical violence, looting, and arson carried out especially by those wearing helmets to prevent identification on the night of 09 May and the following night. The houses of government politicians, destroyed in the mayhem carried out in front of police in many instances, numbered over 70.

The following is the text of the BASL’s letter to the AG: Members of the Bar Association of Sri Lanka (BASL) have drawn our attention to instances of indiscriminate arrests by the police in relation to the violence which occurred in the wake of the incidents of 9th of May 2022 and thereafter.They have raised serious concerns over the partiality of the Police Department, in carrying out investigations and making arrests over incidents of violence across the country. The gravity of these allegations are compounded by the recent revelations attributed to the Inspector General of Police of political bias on the part of many Officers-in-Charge of Police Stations and the manner of their selection.

Among the instances of partiality alleged are:

a) Arrests being carried out without verifying claims that the suspects were not at the scene of the crime but were elsewhere at that time;

b) Arrests being carried out of suspects without any credible material but solely on the basis of lists provided by interested parties including politicians;

c) Arrests being done solely on the basis that persons had participated in peaceful protests against the government between March and May 2022;

d) Applications for holding identification parades being made without any material against certain individuals merely for the purpose of having them remanded in custody until the conclusion of the parades;

e) Photographing suspects prior to identification parades leading to suspicions of such photographs being shown to witnesses prior to such parades;

f) The indiscriminate use of Emergency Regulations which have now lapsed to keep persons in remand custody;

We hardly need to emphasis on the need for police investigations to be independent and impartial and to be free from unlawful interferences. Allegations of bias against the law enforcement authorities will lead to a serious loss of public confidence and will worsen the law and order situation in the country.Such allegations will also impact on the human rights situation in the country and could also lead to other consequences which may well affect moves to restore political, economic and social stability in Sri Lanka.We urge you to take note of the above and take urgent measures to advise the police to ensure that all investigations take place within the parameters of the law and are conducted in an independent and impartial manner.”

The BASL has also raised the issue with IGP C.D. Wickremaratne. Having essentially informed the IGP of the matter the BASL has raised with the AG, the outfit has urged the Police Chief to be independent and impartial and to be free from unlawful interferences. Allegations of bias against the law enforcement authorities will lead to a serious loss of public confidence and will worsen the law-and-order situation in the country. Such allegations will also impact on the human rights situation in the country and could also lead to other consequences which may well affect moves to restore political, economic and social stability in Sri Lanka.We urge you to take note of the above and take urgent measures to immediately advise your subordinate officers to ensure that all investigations take place within the parameters of the law and are conducted in an independent and impartial manner.”

President Anura Kumara Dissanayake stated that the Government is taking steps to establish a comprehensive mechanism, supported by an appropriate legal framework, to bring together university academics, experts and all relevant parties in order to resolve issues arising during the implementation of education reforms.

The President made these remarks during a discussion with the Federation of University Teachers’ Associations (FUTA) held on Wednesday (21) morning  at the Presidential Secretariat.

During the discussion, FUTA members emphasized the challenges encountered while trying to implement educational reforms through a framework established by the National Institute of Education, in line with the current laws and regulations.

They further emphasized that while their association acknowledges the need for new education reforms, the urgency of such reforms is greater for students in rural schools than for those in urban schools.

The Federation of University Teachers’ Associations further stated that they appreciate the decision taken by the Government, under the leadership of the President, to address the issues arising from education reforms and affirmed their readiness to contribute to this process.

As a continuation of the previous discussion, proposals addressing the challenges faced by academics within the university system, along with possible solutions, were presented to the President. In response, the President emphasized that the Government would take all possible measures to safeguard the university system and strengthen education.

The discussion also covered proposed amendments to the Universities Act.

President Anura Kumara Dissanayake noted that, in the aftermath of the recent disaster, the Government has been effectively implementing a nationwide rebuilding programme, addressing economic stability, development and all critical sectors. The President also called upon university academics to actively support these reconstruction efforts.
